1. Acceptance of Terms
By accessing or using the ProGold platform (pro.gold), including its website, applications and APIs (the "Services"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction. You are responsible for ensuring that your use of the Services is permitted under the laws applicable to you. The Services are not offered to residents of jurisdictions where digital-asset trading is prohibited.
3. Account Registration and Security
You must provide accurate registration information and keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately of any unauthorised use. We may require identity verification (KYC) before enabling certain features, including withdrawals.
4. Risk Disclosure
Trading digital assets, commodity futures, perpetual contracts and other products offered on the platform involves substantial risk of loss and is not suitable for every person. Prices can be extremely volatile and past performance is not indicative of future results. You may lose the entire value of your holdings. Nothing on the platform constitutes investment, legal or tax advice, and no return of any kind is guaranteed.
5. Fees
Fees applicable to trading, deposits and withdrawals are displayed within the Services and may change with prior notice. You are responsible for all taxes arising from your use of the Services.
6. Prohibited Conduct
You may not use the Services for money laundering, terrorist financing, fraud, market manipulation (including wash trading and spoofing), or any unlawful purpose; interfere with the operation of the platform; or attempt to gain unauthorised access to other users' accounts or our systems.
7. Suspension and Termination
We may suspend or terminate your access, or restrict specific features, where required by law, to protect the platform or other users, or upon breach of these Terms. Where lawful, we will give you notice and an opportunity to withdraw remaining assets.
8. Intellectual Property
All content, trademarks and software comprising the Services are owned by or licensed to the platform operator and are protected by applicable intellectual-property laws. You are granted a limited, revocable, non-exclusive licence to use the Services for their intended purpose.
9. Disclaimers and Limitation of Liability
The Services are provided on an "as is" and "as available" basis without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, loss of profits, or losses arising from market movements, network failures, or events beyond our reasonable control.
10. Amendments
We may amend these Terms from time to time. Material changes will be announced through the platform. Continued use of the Services after changes take effect constitutes acceptance of the amended Terms.
